Welcome to GoodFeathers Gaming & Collectibles! The terms "we", "us" and "our" refer to GoodFeathers Gaming & Collectibles. We operate this store and website, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience (the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (these "Terms"), together with any policies referenced herein, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, you may be asked to provide information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS
We make every effort to accurately represent our products and services. Colors and appearance may differ from your screen due to device settings.
We do not warrant that the appearance or quality of products will meet your expectations or match depictions in our store.
Many of our products are made to order. Please allow 3–5 business days of production before dispatch; production time is separate from shipping transit time. Custom and personalized items (including items made with your name, gamer tag, photo, custom design, or character details) are final sale and can only be remade or replaced if they arrive damaged, defective, or different from the approved design.
Product descriptions are subject to change without notice. We may discontinue products or limit quantities per person, region or jurisdiction.

SECTION 3 - ORDERS
Placing an order is an offer to purchase. We may accept or decline orders at our discretion; an order is not accepted until we confirm it. We must receive and process your payment before acceptance. Review your order carefully, as we may be unable to accommodate cancellations after acceptance. If we do not accept, change, or cancel an order, we will try to notify you via the contact details provided.
Purchases are subject to return or exchange solely under our Refund Policy.
You represent that purchases are for personal or household use, not commercial resale or export.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions may change without notice. The price charged is the price in effect when you order, as shown in your confirmation email.
Prices exclude taxes, shipping and handling, which are calculated at checkout.
We strive for accurate pricing but do not guarantee error-free prices. If we find a pricing error after you order, we will inform you and let you proceed at the corrected price or cancel.
We may refuse, limit or cancel orders, including by account, payment method, or address, and may limit orders that appear to be from dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and payment information and to update it as needed.
You represent that (i) your payment information is true and complete, (ii) charges will be honored, and (iii) you will pay posted prices plus applicable taxes and shipping.

SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping or delivery delays. Delivery times are estimates only, not guarantees. We are not responsible for delays by carriers, customs, or other factors beyond our control. Risk of loss and title pass to you upon delivery to the carrier.

SECTION 6 - INTELLECTUAL PROPERTY
All Services content — including text, images, graphics, designs, photographs, videos, logos, slogans and other materials (the "Content") — is owned by us or our licensors and protected by intellectual property laws.
You may use the Services for personal, non-commercial use only. Do not reproduce, distribute, modify, create derivative works of, display, perform, republish, download, store or transmit our materials except as permitted here.
Our names, logos, and designs are our trademarks. Do not use them without prior written permission.
Breach of this section ends your right to use the Services immediately, and you must return or destroy copies at our option. No rights are transferred to you; all rights not expressly granted are reserved.

SECTION 7 - OPTIONAL TOOLS
We may provide third-party tools as part of the Services, offered "as is" and "as available" without warranties or endorsement. We have no liability for your use of them. Your use is at your own risk; review the third party's terms. New features we add are also subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS
Our Services may link to third-party sites and materials. We do not control, endorse, or accept liability for them or their products and services.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify, which provides the ecommerce platform. Shopify is not a party to these Terms. Purchases, orders and disputes are solely between you and GoodFeathers Gaming & Collectibles.

SECTION 10 - PRIVACY POLICY
Personal information we collect is handled under our Privacy Policy, which you acknowledge by using the Services.
Because Shopify hosts our Services, Shopify also collects and processes personal information to provide and improve the Services. See Shopify's Consumer Privacy Policy for details.

SECTION 11 - FEEDBACK
If you submit ideas, suggestions, feedback or reviews ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and display it in any media. You represent you own the Feedback and it does not infringe others' rights or contain unlawful material.
We may, but need not, monitor or remove Feedback. You are solely responsible for your Feedback and its accuracy.

SECTION 12 - ERRORS AND OMISSIONS
Our Services may contain typographical errors or inaccuracies about products, pricing, promotions, shipping or availability. We may correct errors and change, update or cancel orders based on inaccurate information at any time without prior notice, including after you order.

We may technically limit Agent access, including purchases. Agents must identify themselves in requests, obey robots.txt, respect rate limits, and not circumvent controls. Obligations incurred before termination survive it.
These Terms apply until terminated by you (by notifying us or ceasing use) or by us. If we believe you violated these Terms, we may terminate without notice; you remain liable for amounts due, and we may deny access.

Information on our Services is for general information only; reliance is at your own risk.
EXCEPT AS WE EXPRESSLY STATE, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Neither we nor Shopify warrant uninterrupted, secure or error-free Services.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS AND LICENSORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, THIRD-PARTY CONDUCT OR CONTENT, CONTENT OBTAINED FROM THE SERVICES, OR UNAUTHORIZED ACCESS TO YOUR TRANSMISSIONS, WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY.

SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless GoodFeathers Gaming & Collectibles, Shopify, and our affiliates, officers, directors, agents, contractors, licensors, service providers, suppliers and employees from third-party claims, including reasonable attorneys' fees, arising from your breach of these Terms, incorporated documents, or violation of law or third-party rights. We may assume exclusive defense at our expense; you will cooperate and not settle without our written consent.

SECTION 19 - SEVERABILITY
If any provision is found unlawful, void or unenforceable, it will be enforced to the fullest extent permitted and severed from these Terms; the remaining provisions stay valid.

SECTION 20 - WAIVER; ENTIRE AGREEMENT
Our failure to enforce a right is not a waiver of it.
These Terms and any posted policies or rules are the entire agreement between you and us about the Services, superseding prior agreements. Ambiguities are not construed against the drafter.
